NHS Continuing Healthcare funding was established so that the NHS would pay the full cost of care fees for people if they had a ‘primary health need’. Many people don’t know about this funding, and aren’t informed it exists. It combines health and social care, and is funded by NHS Clinical Commissioning Groups. It applies to people whether they are in residential care, a nursing facility or receiving care at home.
Many people don’t realise that paying a care fee ‘top up’ – i.e. contributing to the costs of social care – is voluntary when individuals aren’t seeking care beyond what they require. However, councils often ask people to contribute, while individuals don’t realise that they are not obligated to do so. Just Caring Legal specialises in care home fee recovery, or refunding ‘third-party top-up fees’.
Just Caring Legal works sensitively with the preparation of wills, listening to your concerns and desires around the future. Preparing a will is the simplest way to ensure that your wishes are carried out after you have passed away. They are also protection for loved ones when you have gone. Without a will, there may be difficulties around distributing an estate, for example. Additionally, it is easier to establish who possesses legal authority to act on behalf of the deceased if there is a will and you have submitted a claim for NHS Continuing Healthcare funding.
A Lasting Power of Attorney is another protective legal document. An LPA allows you to appoint someone you trust to be able to make important decisions on your behalf if you reach a situation where you are no longer able to do so. This could be if you lose mental capacity, or become so ill that you are unable to express your wishes. Making preparations in advance, such as establishing Lasting Power of Attorney can have significant benefits, such as making it easier for your family to fulfil your wishes.
